   Bush has won yet another battle against the rule of law. Cowardice triumps over real patriotism which holds true to values even and especially when challenged! I doubt this travesty of elemental justice will make America any safer but it will surely endure as our everlasting shame for decades to come.

   Recall Japan being asked to apologize this week for the abuse of camp women in World War II, 60 years later. A German friend of mine born long after World War II explained to me one day that shame for what happened in Nazi Germany is her heritage, to be assumed day after day. “It is part of who we are as a people,” she said “nothing, not the passage of time, will ever take it away.” Guantanamo is now part of who we are as Americans, forever.

   The right to a fair trial and representation by a lawyer is fundamental to everything that America stands for. To deny this to these suspects goes against everything upon which this country was founded. They may very well be guilty of great crimes. If so, they should be punished to the full extent of the law, yet if we do not provide the sunlight and openness to these proceeding, the world will always doubt that justice was truly done.

   That is the problem Bush has and why he refuses to let in the light of day. In the vast majority of cases against detainess the government has no reliable evidence that would stand up in a court of law. From what I know only about ten detainees out of the four hundred or so that they hold have ever been charged with anything.

   That is why there are the games about military commissions, allowing evidence obtained through torture, and deeming some evidence classified and not even allowing the detainee to know what it is.
